My wife went to Don herring to BUY a car. We wanted Something for us and four children. We saw the advertisement zero down. When we decided on the Montero we wasn't qualified. I called my mother and she agreed to co-sign for us to get whatever we wanted. So we decided on the Diamente.

The salesman told us that we didn't qualify for that car either. We told him that my mother was going to co-sign for us. We told him that she didn't live here in Texas. He said that he had to talk with the finance department. So he came back with the okay and we called her on the phone. He talked with her and he asked her for her social security number and driver license number to run a credit check. He saw that she had A-1 credit he ask her could she fax in a copy of her information.

Talking with her he told that she would be co-signing for us to buy a 2002 Diamente. She agreed to fax the information. He told her that since she wasn't here in Texas he could Fed-ex her the contract and he will high the area she would have to sign. He told her that the Guy will bring the contract to her and all she has to do is sign and give it back to the guy. He lied because we all thought we was buying this car. Now we are stuck with this car and a big family of 7 now. We can't trade because We will be upside down and 23,000 still owe and they are reporting us late. What Can I do. Is there a Class Action Lawsuit Against Mitsubishi. Can I get some Help!!!!!!!!!!

This is a straw purchase

Well here is a classic catch 22 case. You could call mmca and tell them that you have the vehicle and you mother purchased the vehicle. but when you do this will alert mmca to fraud and then. mmca try to come after your mother.
So you mean to tell us that you had no idea you were purchasing this other vehicle? if this is true. I would contact mmca. and tell them exactly what happened.
In case I have lost you. A straw purchase is when a consumer uses someone elses credit rating to outright purchase a vehicle. this is fraud to a bank.. basically the dealership told you to lie and use your mothers credit to buy a car. this is illegal. it is up to you on what the next step is.. me personally I would get the payments caught up. and keep them caught up until this is resolved. hope this helps

Customer Response

As a three time purchasing customer from Don Herring, there has never been an unclear moment in what I was buying and I will continue to purchase from Don Herring. I have found the sales, service and management staff to be very friendly, courteous and forthright in their dealings with me, my family, and friends I have referred.

I do not live in the area, and when purchasing a vehicle; I have driven over 8 hours just to deal with Don Herring sales.

I have only had one complaint, one year after the purchase of a used vehicle, and that was taken care of with a phone call, and the problem was solved at no cost to me.

It would seem from you original complaint, you have not made your stance clear to the right people at Don Herring. I am not sure how a person does not realize what they are buying, especially when they get their mother involved, but I guess anything is possible.

None the less, you have yourself in a pickle of a situation, and my suggestion is to sit down calmly with the General Manager at Don Herring to see what your options are. It worked for me with just a phone call, and I believe it will work for you.

If not, the Texas Attorney General, has a Consumer Protection Unit right there in Dallas who deal with situations like this.

However, they do not cure bad financial decisions made on the part of the consumer.

Thank You
